Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) describes activities that are prohibited on Zvani. It forms part of your agreement with Zvani. Breach of this AUP is a material breach of the Zvani Terms of Service and grounds for suspension or termination without refund.

1. Scope and responsibility

This AUP applies to you (the “Customer”), your employees, agents, and anyone using your Zvani account. You are responsible for ensuring your team, your end users, and anyone using your account complies with this AUP.

2. Prohibited use

You must not use Zvani to:

a. Break the law

  • Commit, facilitate, encourage, or threaten any illegal act under the laws of India or any jurisdiction applicable to your use of Zvani.
  • Process personal data without a lawful basis under the DPDP Act, GDPR, or other applicable data protection law.
  • Violate telecommunications regulations, including TRAI’s Distributed Ledger Technology (DLT) framework in India, TCPA in the United States, ePrivacy rules in the EU, or equivalent local laws.
  • Engage in fraud, money laundering, sanctions evasion, or terrorism financing.

b. Spam, harass, or deceive

  • Send unsolicited bulk or commercial communications, spam, or unwanted promotional content.
  • Place calls or send messages to people who have not given the required consent or who have opted out.
  • Place calls or send messages to numbers on national or business-specific do-not-call registries without a lawful basis.
  • Engage in harassment, threats, intimidation, doxxing, stalking, or any abusive conduct.
  • Misrepresent your identity, your business, your location, or the purpose of a call or message.
  • Impersonate any individual, business, or public authority.
  • Operate phishing, vishing, smishing, or other social engineering campaigns.

c. Disable or shorten the in-call notice

  • Disable, modify, or shorten the in-call notice that Zvani plays to callers below the legal minimums for the jurisdiction where the call originates or terminates.
  • Mislead callers about the recording of the call or the fact that they are interacting with an AI agent.

d. Target minors

  • Deploy Zvani for use cases primarily targeting callers under the age of 18, including direct caller interaction at pediatric clinics, coaching services where the minor is the typical caller, or children’s products and services.
  • Knowingly collect personal data from minors through Zvani.

e. Operate prohibited industries

Unless you have specific written authorisation from Zvani, you must not use Zvani in or on behalf of:

  • Real-money gambling, sports betting, and lotteries.
  • Adult content or adult dating.
  • Illegal substances or drug paraphernalia, including unlicensed sale of regulated pharmaceuticals.
  • Multi-level marketing, pyramid schemes, or related recruitment programmes.
  • Weapons, ammunition, or explosives (including 3D-printed firearms parts).
  • High-risk financial products such as binary options, forex schemes targeting retail investors, and unregistered investment advice.
  • Activities that promote, glorify, or facilitate self-harm, suicide, or eating disorders.
  • Content that exploits, sexualises, or endangers children.

f. Abuse the platform

  • Attempt to extract, replicate, or reverse-engineer Zvani’s models, prompts, or systems.
  • Use Zvani to train a competing AI service.
  • Probe, scan, or test the vulnerability of the Service without prior written authorisation (see vulnerability disclosure).
  • Interfere with or disrupt the Service, sub-processors, or other customers’ use.
  • Exceed documented rate limits, abuse free tiers, or create multiple accounts to circumvent limits.
  • Share access credentials or API keys with third parties.

3. Outbound calling and messaging

Zvani is built inbound-first. Outbound calling and messaging is subject to additional obligations:

  • You must have a lawful basis for every outbound contact and be able to produce evidence on request.
  • You must maintain and honour do-not-call and opt-out lists, including any list you import into Zvani and any list Zvani provides.
  • You must comply with India’s TRAI DLT framework for promotional content and with local equivalents elsewhere.
  • US outbound calling is gated. Calls and messages to US numbers require prior Zvani approval, TCPA compliance attestation, and a separate Outbound Calling Addendum.
  • Bulk outbound campaigns require an Outbound Calling Addendum regardless of jurisdiction.

4. Content you provide to Zvani

You are responsible for the content you provide to Zvani for use in answering callers, including agent prompts, knowledge bases, FAQs, pricing, product descriptions, and connected system data. You represent and warrant that:

  • The content is accurate, current, and lawful.
  • You have the rights to use any trademarks, copyrighted material, or other intellectual property in the content.
  • The content is not defamatory, misleading, fraudulent, or harmful.
  • Where you operate in a regulated sector (healthcare, financial services, legal services, etc.), the content and any advice given to callers comply with your sector’s rules and required disclosures.

5. Account security

  • Keep your credentials, API keys, and integration tokens secure.
  • Enable multi-factor authentication for all administrator accounts.
  • Notify Zvani at security@zvaniai.com promptly if you suspect a credential compromise or unauthorised access.

6. Reporting violations

If you become aware of any use of Zvani that violates this AUP — by your team, your end users, or any third party — you must report it promptly to trust@zvaniai.com. Reports may also be sent to our Grievance Officer (see /grievance) when the violation involves personal data.

7. Enforcement

Zvani may, at its discretion, do any of the following in response to a breach of this AUP:

  • Issue a warning.
  • Suspend access to part or all of the Service.
  • Throttle or block specific call patterns, destinations, or content.
  • Terminate your account without refund.
  • Cooperate with regulators, law enforcement, or affected third parties, including disclosing relevant data where lawfully required.

Where the breach causes harm to Zvani, our sub-processors, or other customers, you indemnify us for the resulting loss as set out in the Terms of Service.

8. Updates to this AUP

Each version of this AUP is published at a stable URL of the form /aup/v{x-y} and listed at /legal/history. Material updates are announced in-product and by email at least 14 days before they take effect.
